License Agreement

IMPORTANT-READ CAREFULLY: This End-User License Agreement ("EULA") is a legal agreement between you the LICENSEE (either an individual or a single entity) and the seller (LICENSOR) of the PRODUCT.

The PRODUCT includes computer software, and may include associated media, printed materials, and "online" or electronic documentation. Any software provided along with the PRODUCT that is associated with a separate end-user license agreement is licensed to you under the terms of that license agreement. By installing, copying, downloading, accessing or otherwise using the PRODUCT, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, the LICENSOR is unwilling to license the PRODUCT to you. In such event, you may not use or copy the PRODUCT.

The games (hereinafter known as the PRODUCT) are is freely distributed. Once the "Product License Key", hereinafter known as the KEY has been requested from the LICENSOR by the LICENSEE then the LICENSEE accepts that the KEY will only unlock the PRODUCT for the COMPUTER it was intended to be installed and played thereon.

Distribution

The LICENSEE accepts that the PRODUCT is given away freely provided it is not decompiled, or disassembled, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.

The LICENSEE accepts that the LICENSOR take no responsibility for loss or damage howsoever caused to any software, firmware or hardware components of the designated computer and/or any peripherals attached or juxtaposed to the same before, during or after installation of the PRODUCT and/or KEY. In no case shall the LICENSOR be liable for any incidental, special or consequential damages or loss, including, without limitation, lost profits or the inability to use equipment or access data, whether such damages are based upon a breach of express or implied warranties, breach of contract, negligence, strict tort, or any other legal theory.

The LICENSEE accepts that the LICENSOR is at all times the owner of the component parts of the PRODUCT both tangible and intangible and is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The PRODUCT is licensed, not sold. The term "COMPUTER" as used herein shall mean the HARDWARE, if the HARDWARE is a single computer system, or shall mean the computer system with which the HARDWARE operates, if the HARDWARE is a computer system component.

The LICENSEE must not remove or alter any copyright notices on all copies of the PRODUCT or allow the aforesaid by a third party .

The PRODUCT is licensed as a single PRODUCT. Its component parts may not be separated for use on more than one computer unless licensed for by special request.

The LICENSEE may not rent or lease, the PRODUCT but may distribute it provided that there is no charged made to the third party in question.

The LICENSEE may only install and use the PRODUCT on the designated COMPUTER once the KEY is installed.

This PRODUCT and accompanying documentation are provided "as is" and without warranties as to performance of merchantability or any other warranties whether expressed or implied. Any liability to LICENSOR will be limited exclusively to KEY replacement or refund of the cost of the said KEY at the time of acquisition.

DISCLAIMER

The KEY only works for the COMPUTER it was registered to. Each COMPUTER requires a unique KEY. If the LICENSEE wishes install copies on other COMPUTERS the LICENSEE will have Register the serial number to receive THE APPROPRIATE KEY for that COMPUTER.

It is the LICENSEES responsibility to check that the PRODUCT works satisfactory on their COMPUTER before approaching the LICENSOR for the KEY.

Whist every endeavour has been made to supply this PRODUCT in perfect condition, if it comes to the attention of the LICENSOR that improvements or enhancements are required or desired by the LICENSOR then the LICENSOR with place the improved PRODUCT on the www.simplypoker.com web site for any LICENSEE to download for FREE save for any cost incurred to the LICENSEE in doing so.
